How to conclude the online sales contract
In order to conclude the online sales contract of one or more products on the website, you will have to fill out the order form in electronic format and send it to AQUA EUROPE Srl, via telematic, following the instructions and the procedure that will find already automated on the site.
The order form contains a summary of the General Conditions of Sale and the main data of its order such as: information about the shipment, summary of the method of payment and shipment chosen by you, a summary of the product purchased bearing the name of the item, the quantity purchased, the total partial, the taxes included (VAT) and the total amount of the order.
The contract may be completed when AQUA EUROPE Srl has received its order form electronically and, after verification of the correctness of the data relating to the order, You will notify you by e-mail to your e-mail address of your order confirmation, or you will send your order directly. The General Terms and Conditions of Sale are deemed to be accepted if you purchase one or more products. The order form will be stored at our database for the period of time necessary for order evasion and in any case in the terms of law. You can access your order form by consulting the “My order” section in case you have decided to purchase as a registered user and not as a guest. Completed the purchase process, AQUA EUROPE Srl will take charge of its order and send you all communications regarding the shipment of the purchased products.
PROVISIONS OF PRODUCTS
The products offered through the website will be available only in the following countries: Italy.
All product orders are subject to availability. We will notify you of any unavailable products ordered within 6 (six) days from the day after the day on which the order has been sent; we reserve the right to provide you with all information regarding quality replacement products and value equal to or greater than the ordered products and that you may decide to request. In case of forwarding the order form and early payment of the total due, and in case you do not wish to place an order of replacement products, we will refund them for the entire amount already paid according to the time schedule and the rules specified in the right withdrawal section.
ANNUAL ORDER
Together with the cases of false or fraudulent orders mentioned above, we will not be able to give course to your orders even if they come from countries not including those authorized, in case they do not give sufficient guarantees of solvency or are incomplete or otherwise incorrect. In such cases we will inform you by e-mail to your e-mail address about the fact that the sales contract has not ended and that we will not follow your order specifying the reasons.
We reserve the right to remove any product from the website at any time and/or delete or modify any material or content of the same. Exceptional circumstances may therefore occur which oblige us to refuse the forwarding of an order even after sending the Order Confirmation.
Guarantees and indication of product prices
The essential characteristics of the products are indicated on the website within each product card. In particular, each product sheet indicates: Product name, price, description, product image, functions, technical specifications, etc. The prices of the products may be subject to updates and/or changes, for this reason we ask you to make sure about the final price of sale before submitting your order form. In case we encounter errors in the price of the products ordered by you, We will inform you promptly and give you the opportunity to confirm your order again with the indication of the correct amount or to cancel it; in case we fail to contact you, the order will be cancelled and you will be refunded in full the amount paid. Passage of product ownership
The risks related to the products you ordered will be transferred to you from their shipment. You will acquire the property of the ordered products as soon as we have received the total amount related to them, including any shipping costs.

Applicable law and dispute settlement
These General Conditions of Sale are governed by Italian law and in particular by Legislative Decree 206/2005 (Consumer Code) and by Legislative Decree no. 70 of 9 April 2003. The Court responsible for resolving disputes arising from the online sales contract is that of Busto Arsizio (VA)
TERMS AND CONDITIONS
The contract between AQUA EUROPE Srl Via Don Carlo Gnocchi 66-68 Gerenzano (VA) P.Iva 03266880123 and the Customer, must be concluded with the acceptance, even partial, of the order by AQUA EUROPE. By placing an order, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions below.
PRICE
Prices shown on all pages of our website are VAT included Prices do not include transport unless expressly indicated. The full price and the discounted price are indicated for each item.
PAYMENT METHODS
The customer can choose to pay through the various proposed ways: IT 'S CALLED REVOLUT PAYPAL, SCALAPAY if you buy with Scala, you receive the order immediately and you pay in 3 installments. The Customer acknowledges and authorizes that the instalments will be given to : Increment SPV Srl,to subjects related to them and their cessionaries. SOISY if you buy with SOISY, you immediately receive the order and you pay in 10 installments at zero rate. The Customer acknowledges that the financing agreement will be entered into directly with SOISY. BONIFICO BANCARIO CONTRASSEGNO with supplement of €.4,50.
ORDER
Orders will be accepted for the minimum and maximum quantities indicated (only where specified). For each order made it will be necessary confirmation by email AQUA EUROPE Srl
MODE OF ACQUISTO
Customer can buy every product on https://shop.aquaeurope.eu/en/trattamento-acqua-potabile The correct reception of the order is confirmed by EUROPEAN AQUA with an e-mail response, sent to the email address communicated by the Customer. This message of confirmation will report a 'New Order', to be used in any further communication with AQUA EUROPE. The message reproduces all the data entered by the Customer who undertakes to verify its correctness and to communicate promptly any corrections, according to the methods described in this document. In the event of non-availability of the product concerned and/or impossibility of acceptance of the order, AQUA EUROPE guarantees prompt communication to the Customer, always by e-mail.
RECESS LAW
Pursuant to Legislative Decree 206/2005, if the customer is a final consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to AQUA EUROPE a reference of VAT Partition), he has the right to withdraw from the purchase contract for any reason, without having to provide explanations and without any penalty, subject to the following point.
To exercise this right, the customer must send to AQUA EUROPE a communication in this sense, within 14 working days from the date of receipt of the goods, to the address AQUA EUROPE Srl Via Don Carlo Gnocchi 66-68 Gerenzano (VA).
Once the aforementioned withdrawal notice has been received, the AQUA EUROPE Customer Service will quickly communicate to the customer the instructions on how to return the goods, which will be sent to AQUA EUROPE within 14 days of this notice.
The right of withdrawal is subject to the following conditions:
the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
the purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessories);
to limit damage to the original packaging, we recommend, when possible, to insert it in a second box, showing the number of RMA (return authorization code);
to avoid in all cases the application of labels or adhesive tapes directly on the original packaging of the product;
the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
in case of damage to the goods during transport, AQUA EUROPE will notify the customer of the event (within 5 working days from receipt of the goods in its warehouses), to allow him to press promptly complaint against the courier he chooses and obtain the reimbursement of the value of the goods (if insured);
in this eventuality, the product will be made available to the customer for his return, canceling at the same time the request for withdrawal;
AQUA EUROPE does not respond in any way to damages or theft/loss of goods returned with uninsured shipments;
upon arrival in stock, the product will be examined to assess any damage or tampering not resulting from the transport. If the original packaging and/or packaging are ruined, AQUA EUROPE will retain a refund of 20% of the original packaging, as a contribution to recovery costs.
Without prejudice to any recovery costs for damages ascertained to the original packaging, AQUA EUROPE will refund to the customer the amount already paid (if the Customer does not decide to buy goods of equal amount), in the shortest possible time and however within 14 days from the request of withdrawal, through procedure of cancellation of the amount charged on the Credit Card or through Bank Transfer. In the latter case, the customer will promptly provide the bank details on which to obtain the refund (Cod. IBAN of the invoice holder).
The right of withdrawal is totally lacking, due to lack of the essential condition of integrity of the good (confection and/or its content), in cases where AQUA EUROPE accesses:
the lack of the external packaging and/or the original internal packaging the absence of integral elements of the product (accessories, manuals, parts, etc.);
damage to the product due to causes other than its transport.
In the event of the cancellation of the right of withdrawal, AQUA EUROPE will return the purchased goods to the sender, charging the same shipping costs.
DISDEPT OF A ORDER
The customer may cancel the order by simply sending an e-mail to info@aquaeurope.eu provided the same has not yet been processed.
TARDEN DISDEPT
If the cancellation takes place after the shipment of the goods, the customer will be required to receive the goods, requiring the authorization to return. After the return, the credit note will be issued and the customer will be refunded of the amount paid, excluding transport charges.
RESPONSIBILITY'
The Buyer with the Order assumes the responsibility for compliance with the laws and safety regulations relating to the use of the purchased products. Therefore, any liability of the Supplier for any direct or indirect damage caused to persons or things by the improper use of the products provided is excluded. The Supplier may in no event be held liable, even indirectly, for the failure or insufficient operation of the products and/or consequential damages.

The sale contract between the Customer and AQUA EUROPE is concluded in Italy and regulated by the Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his municipality of residence; in all other cases, the territorial competence is exclusively that of the Forum of Busto Arsizio.
