By using this website and/or placing orders through it, you agree to:
Make use of the website for the sole purpose of making consultations or orders that are legally valid
Not to place false or fraudulent orders. Should we have a valid reason to believe that such an order has been placed, we will be authorized to cancel it and promptly notify the appropriate authorities
Have an obligation to provide us with your e-mail address, mailing address, and/or other contact information in an absolutely truthful and correct manner; likewise, you will allow us to make use of this information in order to contact you.
If you do not provide us with all the information we may need, we will not be able to follow up on your order. By placing an order through this the website you warrant that you are of legal age i.e. 18 years of age or older and have the legal capacity to enter into contracts that are binding.

How to conclude the online sales contract
In order to conclude the contract for the online sale of one or more products on the website, you must complete the order form in electronic format and transmit it to AQUA EUROPE Srl, electronically, following the instructions and the procedure that you will find already automated on the site.
The order form contains a summary of the General Conditions of Sale and the main data of your order such as: shipping information, summary of the payment and shipping method you have chosen, a summary of the product purchased bearing the name of the item, the quantity purchased, the partial total, taxes included (VAT) and the total amount of the order.
The contract may be said to be finalized when AQUA EUROPE Srl, has received electronically, your order form and, after verifying the correctness of the data relating to the order, will communicate to you by e-mail to your e-mail address the confirmation of the order, or will directly provide for the shipment of the same.
The General Conditions of Sale set forth herein shall be deemed accepted if you proceed to purchase one or more products.
Your order form will be stored in our database for the period of time necessary to process your order and in any case within the terms of the law. You will be able to access your order form by consulting the "my order" section in case you have decided to purchase as a registered user and not as a guest. Once the purchase process has been completed, AQUA EUROPE Srl will take care of your order and send you all communications regarding the shipment of the purchased products.
AVAILABILITY OF PRODUCTS
The products offered through the website will only be available in the following countries: Italy
All product orders are subject to product availability. We will notify you of any unavailability of the products ordered within 6 (six) days from the day following the day you submitted your order; we reserve the right to provide you with any information regarding substitute products of equal or greater quality and value than the products ordered and that you may choose to request. In the event that you submit your order form and prepay the total amount due, and in the event that you do not wish to place an order for replacement products, we will refund you for the full amount you have already paid in accordance with the timelines and rules specified in the right of withdrawal section.
ORDER CANCELLATION
Along with the cases of false or fraudulent orders mentioned above, we will also not be able to process your orders if they come from countries not included among those authorized, if they do not give sufficient guarantees of solvency or are incomplete or otherwise incorrect. In such cases we will inform you by e - mail to your e-mail address that the contract of sale has not been concluded and that we will not follow up on your order specifying the reasons.
We reserve as of now the right to remove any product from the website at any time and/or delete or modify any material or content thereof. Exceptional circumstances may therefore arise that oblige us to refuse to process an order even after we have sent the Order Confirmation.
Guarantees and pricing of products
The essential characteristics of the products are indicated on the website within each product sheet. Specifically, each product sheet indicates: Product name, price, description, product image, features, technical specifications, etc.
Product prices may be subject to updates and/or changes, so we ask that you ascertain the final sale price before submitting your order form.
In the event that we find errors in the price of the products you order, we will promptly inform you and give you the opportunity to either re-confirm your order with the correct amount or cancel it; in the event that we are unable to contact you, the order will be cancelled and you will be refunded the full amount paid.
We would like to point out to you as of now that we will not be obliged to supply you with the product(s) at the lower price by mistake indicated, if the aforementioned mistake was obvious and unambiguous and therefore if it was possible for you to identify it as incorrect in a reasonable manner.
Transfer of ownership of products
Risks relating to the products ordered by you will transfer to you as of their shipment.
You will acquire ownership of the products ordered as soon as we have received the total amount related to them, including any shipping costs.

Applicable law and dispute resolution
These General Conditions of Sale are governed by Italian law and in particular by Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 9 April 2003 No. 70 regulating commercial transactions concluded through the Internet.
The competent court to resolve disputes arising from the online sales contract is that of Busto Arsizio (VA)
TERMS AND CONDITIONS
The contract stipulated between AQUA EUROPE Srl Via Don Carlo Gnocchi 66-68 Gerenzano (VA) P.Iva 03266880123 and the Customer, must be considered concluded with the acceptance, even partial, of the order by AQUA EUROPE. By placing an order, the Customer declares that he/she has read all the indications provided during the purchase procedure and that he/she fully accepts the general and payment conditions set forth below.
PRICES
Prices shown on all pages of our site are VAT included
Prices do not include freight unless specifically stated.
The full price and any discounted price is indicated for each item.
PAYMENT METHODS ACCEPTED
The customer may choose to pay through the various methods proposed:
REVOLUT
PAYPAL,
SCALAPAY if you purchase with Scalapay, you receive your order immediately and pay in 3 installments. The Customer acknowledges and authorizes, that the installments will be transferred to :
Increment SPV Srl,to entities related to them and their assignees.
SOISY if you purchase with SOISY, you receive the order immediately and pay in 10 installments at zero interest. The Customer acknowledges that the financing contract will be concluded directly with SOISY.
BANK TRANSFER
COD with an additional charge of €.4.50.
ORDERS
Orders will be accepted for the minimum and maximum quantities indicated (only where specified).
Electronic mail confirmation from AQUA EUROPE Srl will be required for each order placed
MODE OF PURCHASE
The Customer may purchase any product present on https://shop.aquaeurope.eu/en/
The correct receipt of the order is confirmed by AQUA EUROPE with an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will contain an 'Order Number', to be used in any further communication with AQUA EUROPE. The message will reproduce all the data entered by the Customer, who undertakes to verify their correctness and promptly communicate any corrections, in the manner described in this document.
In case of non-availability of the product in question and / or inability to accept the order, AQUA EUROPE ensures timely communication to the Customer, again by e-mail.
RIGHT OF WITHDRAWAL
Pursuant to D. Lgsl. 206/2005, if the customer is a final consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to AQUA EUROPE a VAT number reference), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the next point.
To exercise this right, the customer must send AQUA EUROPE a notice to that effect, within 14 working days from the date of receipt of the goods, to AQUA EUROPE Srl Via Don Carlo Gnocchi 66-68 Gerenzano (VA).
Once the aforementioned notice of withdrawal has been received, AQUA EUROPE Customer Service will promptly provide the customer with instructions on how to return the goods, which must be received by AQUA EUROPE within a further 14 days of such notice.
However, the right of withdrawal is subject to the following conditions:
the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
the purchased goods must be undamaged and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original package, we recommend, when possible, to put it in a second box, bearing the RMA number (return authorization code); to be avoided in all cases the attachment of labels or adhesive tapes directly on the original packaging of the product;
the shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer;
in the event of damage to the goods during transport, AQUA EUROPE will notify the customer of the incident (within 5 working days of receipt of the goods in its warehouses), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
AQUA EUROPE is not liable in any way for damage or theft/loss of goods returned by uninsured shipments;
upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged, AQUA EUROPE will deduct from the refund due a percentage, however not exceeding 20% of it, as a contribution to the costs of restoration.
Without prejudice to any repair costs for damages assessed to the original packaging, AQUA EUROPE will refund the customer the amount already paid (if the Customer does not decide to purchase goods of the same amount), as soon as possible and in any case within 14 days of the request for withdrawal, by transferring the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN Code of the invoice holder).
The right of withdrawal lapses totally, for lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where AQUA EUROPE ascertains:
the lack of the outer packaging and/or the original inner packaging
the absence of integral elements of the product (accessories, manuals, parts, etc.)
the damage of the product for causes other than its transport
In case of forfeiture of the right of withdrawal, AQUA EUROPE will return the purchased goods to the sender, charging the same for shipping costs.
CANCELLATION OF AN ORDER
The customer may cancel the order by giving simple notice by e-mail to info@aquaeurope.eu provided that the same has not yet been processed.
LATE CANCELLATION
Should the cancellation occur after the shipment of the goods, the customer will still be required to receive the goods, subsequently requesting authorization to return.
Following the return, a credit note will be issued and the customer will be refunded the amount paid, excluding transportation costs.
RESPONSIBILITY
The Buyer with I 'order assumes responsibility for compliance with legal and safety regulations relating to the use of the products purchased.
Therefore, all liability of the Supplier for any and all direct or indirect damage caused to persons or property by the improper use of the products supplied is excluded.
II Supplier in no case can be held responsible, even indirectly, for the failure or insufficient functioning of the products and/or consequential damages.

The sales contract between the Customer and AQUA EUROPE is concluded in Italy and governed by Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Busto Arsizio.
